Lawyers feel free to leap in, but my understanding is that if you photograph something from the public highway (or equivalent), you're OK.  Of course, if you were trespassing, or you had to pay for access, or you stole the camera, you may have a problem.

Bugger. I was looking good until you mentioned nicking the camera. Appreciate your thoughts, It would be interesting to see how these opinions would fare in a court of law! (An interesting exercise only if you are NOT the defendant)
